# Nextera Energy Moat

Status: published. Policy: company-analysis-1.

NextEra Energy has a narrow moat centered on FPL's municipal franchises, limited retail competition and disclosed cost advantage over customer self-generation. Multi-decade contractual protections support durability and customer dependence, but regulated rates constrain pricing freedom. NEER demonstrates project delivery and contracted demand, while price-based commodity competition prevents establishing a separate durable moat. Financing dependence, investment impairments and regulatory exposure limit resilience.

## intangible_assets

FPL's municipal franchises restrict municipal entry: municipalities and counties agree not to form their own utilities during the franchise term. The agreements cover the vast majority of FPL's retail customers, supporting its protected service position.

Durability: Franchise terms are typically 30 years. At December 31, 2025, 226 agreements had varying expirations through 2055. Comparable disclosures for 2023 support persistence, without establishing guaranteed renewal or blanket exclusivity.

Risks: Retail competition is limited but growing. Customers can self-generate, and Florida legislation could facilitate distributed generation or third-party electricity sales. Regulatory protection also comes with restrictions on rates and returns.

Invalidation: Material franchise losses or nonrenewals, municipal utility formation, or enacted retail competition followed by sustained customer or load losses would invalidate the protected-position thesis.

## cost_advantage

FPL discloses that its cost of service is below self-generation costs for a significant majority of customers and that few customers self-supply. This supports an existing economic advantage over customer substitution. The proxy additionally reports non-fuel O&M more than 70% below the national average, although that comparison is issuer-presented and covers only one cost component.

Durability: The self-generation advantage is disclosed for both 2023 and 2025. Its persistence supports a current advantage, but the passages do not establish a durable total-cost lead over named utilities or distributed-energy providers.

Risks: Falling distributed-generation and storage costs, incentives for rooftop solar, and increased infrastructure or financing costs could narrow the advantage. Largely cost-based rates mean operating savings can benefit customers rather than become unrestricted pricing power.

Invalidation: Evidence that self-generation becomes economical for a substantial portion of FPL's customers, accompanied by material self-supply adoption or persistent loss of its disclosed operating-cost advantage, would invalidate this claim.
